MEMORANDUM & ORDER

PLATT, District Judge.

Charles Davis has petitioned this Court, pro se, pursuant to 28 U.S.C. § 2254 for a writ of habeas corpus. Petitioner is presently incarcerated in the Queensboro Correctional Facility for an indeterminate term of two to six years pursuant to a judgment of conviction entered July 17, 1980, in the Supreme Court, Bronx County (Sullivan, J.), after a trial by jury.
