CIRILLO, President Judge Emeritus:

Aziz Elias appeals from the order entered in the Court of Common Pleas of Lancaster County sustaining appellee Lancaster General Hospital’s preliminary objections and dismissing Elias’ spoliation action. We affirm.

■ Elias wears a cardiac pacemaker and has required the aid of one for several years. On December 27, 1994 Elias fell. During the fall, his pacemaker’s lead wires were severed and became lodged in his heart. Elias was immediately transported to Lancaster General Hospital (Hospital) where surgeons successfully removed the wires and replaced them with…
