In this adversary proceeding, Davidson Rehab Associates (“Davidson”, “Plaintiff”, or “Debtor”), filed an Amended Complaint against Defendants United States Department of Housing and Urban Development (“HUD”) and D.W. Associates (“DWA”), and Jerome Belson Associates to avoid a non-judicial foreclosure sale of certain building properties. In its Amended Complaint, Davidson sets forth five causes of action under which it alleges that it may avoid the foreclosure sale.
