SMITH, District Judge.

This is an action to cancel and set aside a certificate of naturalization on the grounds that the same was fraudulently and illegally procured. The jurisdiction of the Court is derived from Section 338(a) of the Nationality Act Of 1940j; 54 Stat. 1158, 8 U.S.C. § 738 (a).* The statutory jurisdiction of the Court is not challenged.
