MEMORANDUM OPINION
RUSSELL, District Judge.
This matter comes before the Court on Defendants’ Second Motion for Summary Judgment (Docket #89). The Plaintiff has responded (Docket # 91), and the Defendants have replied to that response (Docket # 106). This matter is now ripe for adjudication. For the following rea sons, Defendants’ Motion for Summary Judgment is DENIED.
BACKGROUND
