This suit in equity was brought in the Circuit Court of Upshur county in January, 1888, by the administrator and heirs of Samuel II. Mullan, deceased, against Abram Carper and others, to declare null and-void certain judgments, *217decrees, and other legal proceedings had against said Mul-lan and others, under which certain real estate situate in the town of Buekhannon was sold and conveyed to Bennett Carper’s vendee, and to restore the. possession-of said i’eal estate to plaintiffs as the heirs of said Mullan.-
