The facts herein are presented by the pleadings. On January 5, 1943, plaintiff, a Pennsylvania corporation, filed a petition, Count 1 of which asserted that' on June 24, 1942, Samuel J. Ewing, now deceased, delivered to Knox McCalla, for the use, and benefit of plaintiff, a written instrument, as follows:
“Jan. 16 - 40
I hereby convey at my decease all my personal property to Knox McCalla and Homer Woods for disposition. The proceeds to defray expenses, and balance to go to Covenanter Church at Large. Books and Clothing to go to Southern Mission.(s) S. J. Ewing.”
