In a negligence action to recover damages for personal injuries, the defendant Mildank Taxi Corporation appeals from an order of the Supreme Court, Nassau County (Murphy, J.), dated February 3, 1986, which denied its motion for summary judgment dismissing the complaint as against it.

Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint is dismissed as against the defendant Mildank Taxi Corporation (hereinafter the appellant).
