This is the second appearance of this case in this Court. On the former appeal appellant had been convicted of armed robbery and sentenced to a term of twenty-*864five years in the state penitentiary. For various errors committed in the trial of the case we reversed the judgment of the circuit court and remanded the case for another trial. 78 So. 2d 153, not yet reported in the State Reports.

On the second trial of this case appellant was again convicted and sentenced to serve a term of twenty-five years in the state penitentiary. The record shows without substantial dispute that a beer joint…
