OPINION
NYE, Chief Justice.
This is an appeal from an order dismissing plaintiff’s suit for damages. Jack Bryant, the appellant, sold a crop of beets to L. H. Moore Canning Company, the ap-pellee. The appellee failed to make payment for the beets whereupon the appellant made claim against the appellee under the provisions of the Agricultural Protective Act, Article 1287-1, Vernon’s Ann.Civ.St. The commissioner ultimately made findings m favor of the appellant.
