This litigation was begun by a suit brought by appellee against appellant to recover a balance alleged to be due upon a note for $1,260 executed by appellant in part payment for a musical instrument called a Kohler & Campbell piano, with its attachments and a music roll, sold to him by appellee, and to foreclose a chattel mortgage given by appellant upon the piano and attachments to secure the payment of the note.
