I. INTRODUCTION
This matter is before the court on the parties’ motions and cross-motions for summary judgment filed pursuant to Federal Rule of Civil Procedure 56. The motions were filed in Select Specialty Hospital-Denver, Inc. v. Sebelius, 1:10-cv-01356 (BJR) and Cove Associates Joint Venture d/b/a/ Life Care Center of Scottsdale v.
