Casey, J.

Plaintiff is a sewage works corporation organized in 1966 pursuant to article 10 of the Transportation Corporations *480Law, and it provides sewer service to the residents of the Salem Hills subdivision, located in the Village of Voorheesville. Plaintiff’s parent corporation was the developer of Salem Hills. Defendants are the Village of Voorheesville and the Village Board.

Pursuant to section 121 of the Transportation Corporations Law, plaintiff is required to provide sewer service to the residents of Salem Hills “at fair, reasonable and adequate rates agreed to…
