*694In an action, inter alia, to recover damages in quantum meruit and for unjust enrichment, the defendant appeals from so much of an order of the Supreme Court, Westchester County (Nicolai, J.), dated April 10, 2008, as denied those branches of its motion which were for summary judgment dismissing the second and third causes of action.
Ordered that the order is affirmed insofar as appealed from, with costs.
