This suit was brought by Joseph Hanover contesting the right of Marion S. Boyd to hold the office of District Attorney-General for the Fifteenth Judicial Circuit. The bill was filed under sections 2123 et seq., of the Code providing for the contest of elections of judges, chancellors and district attorneys. In the alternative, the bill sought a declaration of rights of the parties under the declaratory judgments statute, Code sections 8835 et seq., if the court was of opinion the bill was not maintainable in the first aspect. The case was heard on demurrer.…
