Appeal by the defendant from a judgment of the Supreme Court, Kings County (Tomei, J.), rendered April 19, 1988, convicting him of attempted robbery in the first degree and burglary in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

Contrary to the defendant’s contention, he was not deprived of the right to be present at a material stage of his trial. The record reveals that after delivering its charge to the jury, the Trial Judge asked in open court whether there were any exceptions to the charge. The prosecutor replied in the affirmative.…
