BRADY, Commissioner.
This is an action for damages arising out of personal injuries the respondent allegedly sustained when his automobile was struck from the rear by defendant’s streetcar. Trial terminated in a jury verdict in favor of respondent in the amount of $4,-000.00. The trial court overruled appellant’s timely after trial motions and it has perfected this appeal. This is the second appearance of this case before this court, the first trial resulting in a $3,500.00 verdict for the respondent.
