Appeal from an order of the Supreme Court (Amyot, J.), entered December 8, 1988 in Fulton County, which, in a proceeding pursuant to RPTL article 7, denied respondent’s motion to dismiss the petition.
Petitioner owns 380 parcels of land within respondent town. The parcels make up part of the Great Sacandaga Lake and its shoreline and are under the control of the Hudson River-Black River Regulating District.
