Appellant was indicted by the December 1981 Mobile County Grand Jury on charges of burglary in the third degree, receiving stolen property, and theft of property. Appellant was arraigned on February 12, 1982, where he waived a reading of the indictment and entered a plea of not guilty. At appellant's trial on April 19, 1982, the State made a motion to nol-pros counts two and three (receiving stolen property and theft of property) of the indictment, which the trial court granted.
