Appeal from an order of the Supreme Court (Crowell, J.), entered April 3, 2013 in Saratoga County, which, among other things, granted defendant’s motion for summary judgment dismissing the complaint.
Defendant and his wife are the owners of a single-family home in the Town of Clifton Park, Saratoga County where they reside. In 2008, defendant retained an architectural firm to draft blueprint plans, which he used to obtain a permit for the purpose of building a two-story addition to his home with an expanded basement addition.
