INTRODUCTION

This is a Declaratory Judgment action filed by State Life Insurance Company (“State Life”) against Frank O’Brien. State Life seeks a declaration that a disability income insurance policy issued to Frank O’Brien is void because of material misrepresentations made by Mr. O’Brien in the application process and because Mr. O’Brien engaged in a scheme to overinsure himself which State Life argues is against Mississippi public policy.
