delivered the opinion of the court:

Mike Sciales, plaintiff in error, (herein called defendant,) was tried without a jury in the criminal court of Cook county and found guilty of the rape of Florence Carroll. Upon denial of his motions for a new trial and in arrest of judgment he was sentenced to five years’ imprisonment in the penitentiary. He brings the case here by writ of error.

At the time of the commission of the offense charged, the prosecutrix was thirteen years old. Her mother worked in a rooming house over a restaurant where the defendant was employed as a cook.…
