Bill for divorce was filed by appellant upon the ground of habitual, cruel and inhuman treatment. There was a prayer for a division of the homestead property by sale *11and partition. Appellee filed an answer and cross-bill, tbe latter praying for a divorce upon tbe ground of desertion and for an award of a one-half interest in said property, same to be in lien of alimony and counsel fees.

The decree adjudicated “Tbat tbe parties should be granted a divorce under all tbe facts and circumstances in tbe case.” It was further decreed tbat tbe parties own each an undivided one-half interest in tbe…
