ULRICH, Judge.

Duane Benton, Director of Revenue, appeals from default judgment entered on Gary Allen Plybon’s petition seeking review of the Director’s decision denying Mr. Plybon a driver’s license. The default judgment entered by the trial court ordered the Director to issue a driver’s license to Mr. Plybon. The trial court subsequently denied the Director’s motion to set aside the default judgment. The issue presented is whether the trial court abused its discretion in refusing to sustain the Director’s motion to set aside the default judgment. Mr. Plybon also seeks damages for frivolous…
