Albert Topper, hereinafter called plaintiff, filed suit against J. Á. Reid and Mary E. Reid, hereinafter called defendants. The substantial allegations of the complaint, so far as necessary for the determination of this case, read as follows:

“That . . . the defendants and each of them were the owners of and in possession of certain ranches and cattle ranges and a large number of range stock. . . .
