I. Introduction
This case is before the Court on motions for summary judgment filed by defendants Timothy Giebeig (Doc. 278), James V. Crosby, Jr. (Doc. 280), Denise McEaehern (Doe. 287), Jimmie Burger (Doc. 288) and Betty Koon, as personal representative for the estate of A.D. Thornton (hereinafter, “A.D.Thornton”) (Doc. 396).
