Appeal from Fulton county court. Oliver C. Collins sued Maria Fairchild for the price of certain lumber. Judgment for defendant, and plaintiff appeals.

Upon the trial of this action in the county court the complaint was dismissed. The action was brought by the plaintiff to recover of the defendant the price of lumber which was furnished by the plaintiff upon the request of Lyman Fairchild, the husband of the defendant, and which was used in the construction of a barn upon the land of the defendant. The defendant resided with her husband upon the premises, and saw the lumber used in the building, and made no objection thereto. Lyman Fairchild was in the plaintiff’s employment when the lumber was furnished, and had been for two years previous…
