J. Milton Erwin, doing business under the trade name of Erwin Motor Sales, was engaged in the purchase and sale of automobiles and in the conduct of a garage and repair shop in connection therewith, all in the city of Wichita Falls. The Victory Motor Company, a private corporation, was likewise engaged in the same character of business in the same city. L. O. Brown was president of this corporation, and he and Mary J. Bever, Oscar Williams, and F. W. Grogan owned all the capital stock of the corporation.
