Plaintiff was injured November 26, 1931, while a passenger in an automobile, which was being operated by her husband, Robert Suschnick, and which collided *476with an automobile operated by Warren Cater. Robert Suschnick was killed and, as his estate was insolvent, there was no probate administration.
