PRICE, Chief Justice.

This is an appeal from the District Court of Ector County by Charles B. Alimón *807from an adverse judgment in an action in which he sought to recover damages for personal injuries from the defendant Texas Electric Service Company. The parties will be here designated as they were in the trial court.

Plaintiff, when he received the injuries sued for, was an employee of O. H. Mc-Allister. He was a swamper on a truck operated by another employee of said Mc-Allister. They were engaged in the course of their employment in moving what is known as a 500 tank on a trailer attached to…
