Appellant, Missouri Public Entity Risk Management Fund (hereinafter “MO-PERM”), appeals the trial court’s grant of summary judgment in favor of Respondent, Charles Maggard Agency, Inc. (hereinafter “Maggard”). MOPERM is a liability insurance carrier that has an agency agreement with Maggard. MOPERM contends the trial court erred in ruling that MOPERM owes Maggard the 1996 and 1997 renewal commissions on the City of Sedalia’s insurance policy with MOPERM. We agree.
