CHRISTIAN, Judge.
— The offense is attempt to poison; the punishment, confinement in the penitentiary for two years.
The injured party, J. S. Adams, was appellant’s father-in-law. According to the. version of the state, three or four years prior to the tranaction resulting in the indictment in the present case, appellant had endeavored to hire one Vestal Lout to kill the injured party. The testimony of the state was to the further effect that appellant had taken out an insurance policy on the life of his father-in-law in the sum of $6,000, $5,000 of .which was payable to,appellant and $1,000 to…
