— In an action to recover damages for breach of an escrow agreement, defendant appeals from an order of the Supreme Court, Kings County (Vaccaro, J.), dated September 1, 1983, which granted plaintiff’s motion for summary judgment pursuant to CPLR 3213 and denied defendant’s cross motion to dismiss the complaint for failure to state a cause of action and for failure to join an indispensable party.
