an action for a divorce and ancillary relief, the defendant third-party plaintiff husband appeals from an order of the Supreme Court, Westchester County (Rubenfeld, J.), entered August 18, 1988, which granted the third-party defendants’ motion pursuant to CPLR 3211 (a) (7) to dismiss the third-party complaint.
