AMENDED MEMORANDUM OPINION

This cause came before the court for a hearing on the motion of plaintiff J.E. Stack, Jr. for a preliminary injunction. In the motion, plaintiff requests that this court order defendants Tenneco, Inc. and Tennessee Gas Pipeline Co. (Tennessee) (1) to desist from recouping prepayments previously tendered at a rate in excess of the thirty percent rate established in the contract between the parties, (2) to immediately pay plaintiff at least the minimum amount presently owing under the contract, and (3) to begin taking gas from the J.E.…
