By admissions in the pleadings it was established that the plaintiff was the owner of certain farm land situated upon the line between Cedar and Clinton counties and that in the year 1926 a public highway was established on this line. It was conceded that William Licht was plaintiff’s predecessor in title and the owner of the land at the time the road was established, and in the building of the highway a cattle pass of plank was constructed underneath the highway for use by William Licht.
