MEMORANDUM AND ORDER OF DISMISSAL
THORNBURG, District Judge.
THIS MATTER is before the Court sua sponte to dismiss the Plaintiffs’ complaint filed August 24, 1999. Due to the allegations of the complaint, the action is dismissed prior to answer by the Defendants.
I. FACTUAL AND PROCEDURAL BACKGROUND
On July 1, 1997, federal agents executed a search and seizure warrant at the offices of Netware International (Netware) in Mooresville, North Carolina. Bear v.
