In this action of contract, goods in the possession of the defendant were attached and the State Street Trust Company was named in the writ as mortgagee, under the provisions of G. L. c. 22 3, § 79. The attachment was made on May 16, 1953, and service was made on the defendants on June 18, 1953. The original writ was returnable and entered in court on June 6, 1953.

On June 8, 1953 the mortgagees filed an answer in court setting forth the facts concerning its mortgages of the attached property, stating the amount due from the mortgagor for which debt the mortgage was security, and…
