The pleadings in this case were oral, and the return of the justice states that the plaintiff declared on a breach of contract. The plaintiff was the tenant of certain premises, one of the walls of the building on which was ordered by the department of buildings, on account of insecurity, to be taken down and rebuilt. The defendant is claimed to have been the contractor employed by the owner of the *713premises to do the work required by the city officials.
