1. Causey brought suit in the city court of Blakely to recover from Sheffield certain described personal property. The petition alleged that the defendant was in possession of the prop*589erty described and had converted the same to his own use. It was also averred that the plaintiff had made demand upon the defendant for the property, and that the defendant had refused to deliver the same to the plaintiff or pay him the profits thereof.
