MEMORANDUM OPINION ON DEFENDANT’S MOTION TO DISMISS ADVERSARY PROCEEDING

This proceeding is related to the bankruptcy filed by Glenda Coleman (“Coleman” or “Debtor”) on July 27,1998, under Chapter 13 of the Bankruptcy Code, 11 U.S.C. § 101, et seq. To date no plan has been confirmed. Grand National Bank (“Grand National” or “Defendant”) repossessed Debtor’s car pre-petition, but had not resold the vehicle.
