{¶ 1} This matter came to be considered by this Court on a petition for a writ of mandamus filed by Relator, Shelly Materials, Inc. ("Shelly") against the Respondents, Clark County Board of Commissioners ("the Board"). On November 30, 2004, the Board filed a motion for judgment on the pleadings, which we denied July 15, 2005.
