Affirming in part and reversing in part.

The John L. Humbard Construction Company built and paved a number of streets in the city of Middlesboro pursuant to an ordinance adopted on April 12, 1920, by the governing authorities of the city. After the work had been completed, it was accepted by the city, and the cost thereof, including the cost of the intersections, was apportioned and assessed against the abutting property.
