This is an action on the case for negligence brought against the defendant to recover for losses alleged to have been sustained by reason of the negligent failure of the defendant to deliver with promptness certain telegrams addressed to the plaintiff. The case was tried before a justice of the Superior Court sitting with a jury and upon the conclusion of the testimony a verdict was rendered for the defendant by direction of the court.
