At issue on this appeal is whether certain records kept pursuant to Federal law by a research facility of the State University of New York (SUNY) are subject to disclosure under the Freedom of Information Law (Public Officers Law art 6) (FOIL). SUNY conducts biomedical research using dogs and cats in its Health Science Center at Brooklyn (SUNY HSC-B). Under the Federal Animal Welfare Act (7 USC §§ 2131-2159), a dealer who provides a research facility such as SUNY HSC-B with a “random source” dog or cat must furnish the research facility with a certification which…
