MEMORANDUM AND ORDER
MAZZONE, District Judge.
This is a libel action. The plaintiff, the Church of Scientology of California (“CSC”), seeks damages from the defendant, Michael J. Flynn, for allegedly defamatory statements made by Flynn and subse quently published in a Florida newspaper. The matter is before the Court on the defendant’s motion to dismiss for failure to state a claim upon which relief can be granted.
Flynn, a Boston attorney, made the statements in November, 1982, in a telephone interview with a reporter from the Clear-water (Florida) Times. The statements concern Flynn’s attempt…
