Plaintiff Amelia Owen (“Owen” or “plaintiff’), individually and as a trustee and beneficiary of the Wade Lupe Construction Company, Inc. Employee Benefit Plan (“Plan”), brought suit against Wade Lupe Construction Company, Inc. (‘WLC”) and Robert Lupe (“R.
