ORDER GRANTING DEFENDANT’S MOTION TO DISMISS FOR LACK OF SUBJECT MATTER JURISDICTION

MCCALLA, District Judge.

Before the Court is Defendant’s Motion to Dismiss for Lack of Subject Matter Jurisdiction, filed January 3, 2005. Plaintiff responded in opposition on February 22, 2005. For the following reasons, De fendant’s motion is GRANTED and Plaintiffs case is DISMISSED.
