Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which denied petitioner’s application for accidental disability retirement benefits.

Petitioner, a police officer, applied for accidental disability retirement benefits alleging that he is permanently disabled due to an injury to his right shoulder that he sustained in an employment-related incident occurring on March 27, 2009. Petitioner’s application was initially denied and he sought a hearing and redetermination.…
