Where counsel for the defendant made a formal motion for continuance of the case, on the ground of the absence of the defendant, and stated in his place that his client’s absence was for “ reasons unknown to counsel,” that he “ needed the assistance of his client and oould not safely go to trial ” without him, and that the defendant was a witness to certain material facts, and where the motion was overruled, the case proceeded to trial, and the cdurt directed a verdict for the plaintiff, and where the defendant, in his motion for new trial, showed that on the day of trial and…
